A recent landmark decision by the courts has highlighted the risks to landowners where previous tenants have contaminated their land.

DEFRA has been advising landowners of these risks for some considerable time but the latest decision reinforces the need for additional caution to be exercised when prospective purchasers are considering buying land.

Anyone who purchases land which is contaminated is most probably going to be responsible for the condition of that land and may need to spend significant time and resources to return the land to a good condition.

If you are thinking of buying land which you think may be contaminated then you would be advised to seek specialist advice on whether it is contaminated and if so how much it would cost to remediate it.
